Welcome to UNIVER VIDEO! UNIVER VIDEO - CNPJ: 30.521.728/0001-20 - Address: Rua João Boemer 296 - CEP 03018-000 - Brás - SP is an online subscription service that offers our subscribers access to movies and other audiovisual entertainment products (“movies and series”), streamed over the internet to computers and other internet-connected devices (“UNIVER VIDEO compatible devices”).

These Terms of Use govern your use of the UNIVER VIDEO service. As used in these Terms of Use, the terms “UNIVER VIDEO service,” “our service,” or “the service” means the service provided by UNIVER VIDEO, which enables the discovery and playback of movies and series, including all features and functionalities, the website and user interface, as well as all content and software associated with the service.

If you are a resident of the United States (including possessions and territories of the U.S.), you agree to the Arbitration Agreement and Waiver of Class Actions as described in Section 15, to resolve any disputes with UNIVER VIDEO (except for matters that may be taken to small claims court).

Please note that these Terms of Use contain hyperlinks that can only be accessed through our website. Therefore, if you are reading these Terms of Use on a UNIVER VIDEO compatible device, you may need to access the website www.univervideo.com to review these additional terms.

Acceptance of Terms of Use

These Terms of Use for UNIVER VIDEO, which include the Privacy Policy and End User License Agreement, govern the use of the UNIVER VIDEO service. By accessing, using, or browsing the UNIVER VIDEO service, you accept and agree to these Terms of Use. If you do not agree to the Terms of Use, do not use the UNIVER VIDEO service.

The UNIVER VIDEO service is provided by UNIPRO EDITORA LTDA. or one of its affiliated companies. The UNIPRO EDITORA LTDA. company that is providing services to you (referred to as “UNIVER VIDEO” in these Terms of Use) and with whom you are entering into this agreement depends on the country where you initiate the UNIVER VIDEO service subscription.

Changes to the Terms of Use. UNIVER VIDEO may change these Terms of Use periodically, including the Privacy Policy, End User License Agreement, and Social Media Terms. These changes will be effective immediately, but for current subscribers, the changes will take effect 30 days after their publication, unless otherwise specified. UNIVER VIDEO will seek to publish previous versions of the Terms of Use, if any, published within the past 12 months. These previous versions can be accessed on the UNIVER VIDEO website (www.univervideo.com).

Privacy. Personal information that identifies individuals is subject to our Privacy Policy, and its terms are incorporated into this document. Please refer to the Privacy Policy to understand our practices.

Communication Preferences. By using the UNIVER VIDEO service, you consent to receive electronic communications from UNIVER VIDEO related to your account. The communication may include sending emails to the email address provided during registration, posting notices on the UNIVER VIDEO service or the “My Account” page, and may include notices related to your account (payment authorizations, password or payment method changes, confirmations, and other transactional information). Such communication shall constitute part of your relationship with UNIVER VIDEO. You agree that any notices, contracts, disclosures, or other communications sent by UNIVER VIDEO to you electronically satisfy legal communication requirements, including the requirement that such communications be in writing. Keep copies of electronic communications by printing a paper copy or saving an electronic copy. You also agree to receive other communications from UNIVER VIDEO, such as newsletters about new features and content of UNIVER VIDEO, special offers, promotions, and market research surveys, whether by email or other means of communication. If you no longer wish to receive certain non-transactional communications from UNIVER VIDEO, simply access the “Email Preferences” link on the “Your Account” page of the UNIVER VIDEO website to manage your communication options. Refer to our Privacy Policy for more details about our marketing communications.

Billing and Subscription Cancellation

Recurring Billing. By initiating your UNIVER VIDEO subscription and providing or designating a payment method, you authorize UNIVER VIDEO to charge the payment method for the amount equivalent to one month of subscription at the current price at the time of billing, as well as any other charges incurred in connection with your use of the UNIVER VIDEO service. You agree that the amount charged each month may vary for reasons such as promotional offers, redemption of prepaid cards and promotional codes, and/or changes or additions to plans. You agree to authorize UNIVER VIDEO to charge your payment method for such variable amounts, which may be charged at once or in multiple installments.

Price Changes. UNIVER VIDEO reserves the right to adjust the prices of the UNIVER VIDEO service, or any part thereof, in any manner and at any time, at its sole and absolute discretion. Except as expressly provided in these Terms of Use, any changes to the prices of the service will take effect by sending a notice via email to you. For subscribers in Brazil, subscription prices may be automatically adjusted annually or more frequently, as permitted by applicable law and according to the General Market Price Index (IGP-M) published by the Getulio Vargas Foundation or another equivalent index applicable to the UNIVER VIDEO service.

Billing Cycle. The subscription fee for the service will be charged at the beginning of the paid period of your subscription and each month thereafter unless and until you cancel your subscription. UNIVER VIDEO will automatically charge the provided payment method on each day of the corresponding month to when your paid subscription began. The subscription fee will have been fully acquired upon payment. UNIVER VIDEO reserves the right to change the billing cycle, especially if it was not possible to charge the subscription fee from your payment method. If your paid subscription started on a day that does not repeat in a given month, UNIVER VIDEO will charge your payment method on an applicable day of the month or on another day it deems appropriate. For example, if you initiated your UNIVER VIDEO subscription or became a paying subscriber on January 31st, your next payment date will likely be February 28th, and your payment method will be charged on that date. The renewal date of your subscription may change due to changes to your subscription. Visit the UNIVER VIDEO website and click on “Subscription History” on the “My Account” page to find out the start date of your next subscription period. UNIVER VIDEO may request authorization from your payment method to prepare for the subscription fee or other charges related to the service. In the context of these Terms of Use, “billing” means to debit, charge, or offset the amount to be paid, as applicable, from your payment method. Unless described otherwise, month or monthly refers to your billing cycle.

No Refunds. PAYMENTS ARE NON-REFUNDABLE, AND THERE WILL BE NO REFUNDS OR CREDITS FOR PARTIALLY USED SUBSCRIPTION PERIODS. However, upon cancellation, you will continue to have access to the service until the end of the current billing period. At any time and for any reason, UNIVER VIDEO may offer discounts to some or all of its subscribers. The value and form of such credits, as well as the decision to issue them, are at the sole and absolute discretion of UNIVER VIDEO. Issuing credits once does not give you the right to credits in the future for similar situations and does not obligate UNIVER VIDEO to issue credits in the future under any circumstances.

Payment Methods. You can edit your payment method details by accessing the UNIVER VIDEO website and clicking on “My Account,” the link displayed at the top of all UNIVER VIDEO site pages. If the full amount due cannot be processed from your payment method, either due to expiration, insufficient funds, or any other reason, and you do not update your payment method details or cancel your account (see the “Cancellation” section below), you will remain liable for the unpaid amounts and authorize UNIVER VIDEO to continue charging the payment method, which may be updated. This may change the dates of your billing cycle. For certain payment methods, the financial institution of the payment method may charge fees for international financial transactions or other fees. Please consult the financial institution of your payment method for more details.

Cancellation. You may cancel your subscription at any time, and you will continue to have access to the UNIVER VIDEO service until the end of the current billing cycle. UNIVER VIDEO DOES NOT PROVIDE REFUNDS OR CREDITS FOR PARTIALLY USED SUBSCRIPTION PERIODS OR UNWATCHED MOVIES OR SERIES. To cancel, visit the “My Account” page on the website and follow the cancellation instructions. If you cancel your subscription, your account will be automatically closed at the end of the current billing period. To see when the account will be closed, click on “Subscription History” in the “My Account” section. If you signed up for UNIVER VIDEO and provided a payment method with an account that is held by a third party, and you wish to cancel your subscription, you may need to cancel together with the third-party account holder of the payment method and access your account to turn off automatic renewal or cancel the UNIVER VIDEO service subscription along with that third party. You may also need to check the billing information of your UNIVER VIDEO subscription with the relevant third parties.

PAYMENT FOR THE PRODUCT

To use UNIVER VIDEO products, the user will pay UNIVER the prices in effect at the time of purchase and/or rental of any content, according to the current prices and payment methods published on the website www.univervideo.com, as well as through the applications available for Android, iOS, Windows 10, and Smart TVs.

Refund, Rental, and Reimbursement Policy.

If the customer regrets making a rental, purchase, or subscription on Univer, they may exercise their right by expressing their interest to Customer Service within 7 (seven) consecutive days from the date of the transaction.

If access to the content is not granted, it will be possible to cancel the subscription, and UNIVER VIDEO will take the necessary steps to refund the customer according to the payment method used for the purchase. This may involve contacting the credit card issuer within 2 (two) business days, so that they can inform the responsible financial institution for the credit (refund), which may appear on the subsequent two credit card statements, depending on the billing cycle.

UNIVER VIDEO Service

You must be 18 years old or of legal age in your state, territory, or country to subscribe to the UNIVER VIDEO service. Minors under 18 years old or the applicable legal age may use the service only with the involvement of a parent or guardian, using the parent's or guardian's account and subject to these Terms of Use.

The UNIVER VIDEO service and all content viewed through the UNIVER VIDEO service are intended solely for personal and non-commercial use. During your UNIVER VIDEO subscription, UNIVER VIDEO grants you a limited, non-exclusive, and non-transferable license to access the UNIVER VIDEO service to watch movies and series solely through the online streaming service and for this purpose. Except for the limited license described above, no other rights, ownership, or interest are granted to you. You agree not to use the service for public exhibitions.

You can watch a movie or series through the UNIVER VIDEO service in the country where you signed up, as well as in countries where the UNIVER VIDEO service is offered and where UNIVER VIDEO has licenses for said movies, documentaries, children's shows, music videos, or series. The available content varies by country. UNIVER VIDEO holds distribution rights for its content throughout the Brazilian territory. There may be limitations on the availability of content, especially for third-party productions, when trying to access your account from another country. The same applies to subscriptions made outside the Brazilian territory. UNIVER VIDEO uses technologies to verify your geographic location and limit content according to the display licenses. THE NUMBER OF DEVICES ON WHICH YOU CAN WATCH UNIVER VIDEO CONTENT SIMULTANEOUSLY IS LIMITED. Access the information about plan changes on the “My Account” page to see the number of devices on which you can watch UNIVER VIDEO simultaneously. The number of available devices for use and online streaming may change periodically at the discretion of UNIVER VIDEO.

UNIVER VIDEO continually updates the service, including the content catalog. Additionally, different aspects of the service are continuously tested, including the website, user interfaces, service levels, plans, promotional features, availability of movies and series, streaming, and prices. UNIVER VIDEO reserves the right to conduct tests, and by using the service, you agree that UNIVER VIDEO may include or exclude you from these tests without prior notice. UNIVER VIDEO reserves the right, at its sole discretion, to periodically and without prior notice, change the way the service is offered and operated.

You agree to use the UNIVER VIDEO service, including all its features and functionalities, in accordance with all applicable laws, regulations, and codes, as well as any other usage restrictions for the service or content specified therein. You agree not to archive, download (except for the cache necessary for personal use), reproduce, distribute, modify, display, publish, license, create derivative works from, sell, or use (except as expressly authorized by these Terms of Use) the content and information contained or obtained from or through the UNIVER VIDEO service without the express written authorization of UNIVER VIDEO and the licensors. You also agree not to: circumvent, remove, alter, disable, degrade, or tamper with any of the content protections of the UNIVER VIDEO service; use any robot, spider, scraper, or other automated means to access the UNIVER VIDEO service; decompile, reverse engineer, or disassemble any software or other products or processes accessible through the UNIVER VIDEO service; insert any code or product, manipulate the content of the UNIVER VIDEO service in any way, or use data mining, data collection, or data extraction methods. Additionally, you agree not to upload, post, email, communicate, or transmit in any way any material intended to disrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment associated with the UNIVER VIDEO service, including software viruses, code, files, or programs.

The availability of movies and series in the catalog will change periodically and vary from one country to another. The image quality of movies and series may vary from computer to computer and from device to device, and it may be affected by various factors, including your location, available bandwidth, and the speed of your internet connection. The availability of high definition (HD) and ultra-high definition (Ultra HD) is subject to your internet service and the functionality of the device used. Not all content is available in HD or Ultra HD, and not all plans allow the reception of content in HD or Ultra HD. A minimum download speed of 5.0 Mbps is recommended to receive HD content, defined as 720p resolution or higher. A minimum download speed of 25.0 Mbps is recommended to receive Ultra HD content, defined as a resolution higher than 1080p. You are responsible for all internet access fees. Consult your internet service provider for information on data usage costs. UNIVER VIDEO makes no claims or warranties regarding the quality of the image on your screen. The startup time for a movie or series may vary depending on various factors, including your location, the available bandwidth at that time, the selected movie or series, and the settings of the compatible device used with UNIVER VIDEO.

The online streaming software for UNIVER VIDEO was developed by or for UNIVER VIDEO and is designed to enable the online streaming of UNIVER VIDEO content to compatible UNIVER VIDEO devices. This software may vary depending on the device and media. The functionality may also vary depending on the device used. BY USING THE UNIVER VIDEO SERVICE, YOU CONFIRM AND AGREE TO OUR TERMS AND CONDITIONS OF USE, OUR PRIVACY POLICY, AND TO RECEIVE UPDATED VERSIONS OF UNIVER VIDEO SOFTWARE AND ASSOCIATED THIRD-PARTY SOFTWARE WITHOUT PRIOR NOTICE OR REQUEST. IF YOU DO NOT ACCEPT THE ABOVE TERMS, DO NOT USE THE UNIVER VIDEO SERVICE. UNIVER VIDEO IS NOT RESPONSIBLE FOR NOR GUARANTEES THE PERFORMANCE OF THESE DEVICES, INCLUDING THE CONTINUOUS COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. By using the UNIVER VIDEO service, you agree to seek resolution of any issues related to the device and its compatibility with the UNIVER VIDEO service exclusively from the entity that manufactured and/or sold you the device. If your UNIVER VIDEO-compatible device is sold, lost, or stolen, deactivate the UNIVER VIDEO-compatible device. If you do not sign out or deactivate the device, other users may access the UNIVER VIDEO service through your account and gain access to certain information in your account. To deactivate a device, follow the instructions on the “My Account” page of the UNIVER VIDEO website.

UNIVER VIDEO may terminate or restrict your use of the service without compensation or prior notice if there is suspicion of (i) violation of any of these Terms of Use or (ii) involvement in illegal or improper use of the service. Works purchased through the “Buy” button should not disappear from the account within a minimum period of 12 months unless these contents are discontinued from the website. Movies rented through the “Rent” button expire after 48 hours from their first playback.

Warranty Disclaimers and Limitations of Liability

The UNIVER VIDEO service and all associated content and software, as well as any other features or functionalities associated with the UNIVER VIDEO service, are provided “as is” and “as available,” with all faults and without warranties of any kind. UNIVER VIDEO makes no representations or warranties of any kind that your use of the UNIVER VIDEO service will be uninterrupted or error-free. UNIVER VIDEO specifically disclaims any liability for the use of applications, devices compatible with the UNIVER VIDEO service, and UNIVER VIDEO software (including ongoing compatibility with our service).

To the maximum extent permitted by law, in no event shall UNIVER VIDEO, its subsidiaries, or its shareholders, directors, officers, employees, or licensors be liable (jointly or severally) to you for any special, incidental, indirect, or consequential damages of any kind, or any kind of damages.

Certain jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain types of damages. Therefore, certain limitations in this section may not apply to you.

No provision in these Terms shall affect any legal rights you may have. If any provision or provisions of these Terms of Use are deemed invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

Gift Cards and Promotions In certain jurisdictions, UNIVER VIDEO service gift cards may be offered at specific locations. Gift cards can be redeemed on the UNIVER VIDEO website at univervideo.com. Gift card redemption is subject to the Prepaid Card Terms found on the back of the card and on the website (univervideo.com). Other types of promotional codes may be made available periodically, including as part of third-party promotions. Promotional codes can be redeemed as described in the specific promotion. Gift cards and promotional codes can only be used once, cannot be redeemed for cash, and cannot be combined with other offers, subject to certain restrictions as determined by UNIVER VIDEO at its sole discretion. If you receive a promotional code through a third-party offer, additional restrictions may apply.

Intellectual Property

Copyrights. The UNIVER VIDEO service, including all content provided by the UNIVER VIDEO service, is protected by copyright, trade secrets, and other intellectual property laws and treaties.

Trademarks. UNIVER VIDEO is a registered trademark of UNIPRO EDITORA LTDA Patents. UNIVER VIDEO has patents that apply to the UNIVER VIDEO service. To learn more about UNIVER VIDEO's patents, please refer to univervideo.com. Claim of Copyright Infringement: If you believe that your work has been reproduced or distributed in a way that constitutes copyright infringement or if you are aware of material that infringes copyright laws through the UNIVER VIDEO service, please notify us through our customer support.

Applicable Law. If you are a resident of Brazil, these Terms of Use shall be governed by and construed in accordance with the laws of Brazil. For all other UNIVER VIDEO subscribers, these Terms of Use shall be governed and interpreted in accordance with the laws of the state of Delaware, USA, regardless of conflicting legal provisions.
You may also have certain consumer protection rights under the legislation of your local jurisdiction.

Use of Provided Information. UNIVER VIDEO shall have the freedom to use any comments, information, ideas, concepts, opinions, techniques, or any other materials contained in any communication you send to us, including responses to questionnaires through the UNIVER VIDEO service, including the UNIVER VIDEO website and its user interfaces, on a global and perpetual basis, without compensation, acknowledgment, or payment to you for any reason, including but not limited to the development, manufacturing, and marketing of products and the creation, modification, or enhancement of the UNIVER VIDEO service. Furthermore, you agree not to assert any “moral rights” to the extent permitted by applicable laws. Please note that UNIVER VIDEO does not accept unsolicited materials or ideas for films and series and is not responsible for the similarity of its content or programming in any media to materials or ideas transmitted to UNIVER VIDEO. If you submit any unsolicited materials or ideas, do so with the understanding that no payment of any kind is due to you and that you are agreeing to release UNIVER VIDEO and its affiliates from any claim or lawsuit relating to the use of such materials and ideas, even if the material or idea is used and is substantially similar to the material or idea you submitted.

Customer Support. For more information about the UNIVER VIDEO service and its features or if you need assistance with your account, please visit the UNIVER VIDEO Help Center (univervideo.com). In some cases, the best option for customer support is to use a remote access tool that provides full access to your computer. If you do not want us to have this access, do not agree to the use of the remote access support tool. UNIVER VIDEO will assist you in other ways. In the event of any conflicts between these Terms of Use and information provided by customer support, these Terms of Use shall prevail.

Validity of Clauses. If any provision or provisions of these Terms of Use are deemed invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
